Who gets what in a divorce?

In Australia, the Family Law Act 1975 governs the distribution of assets and property in case of a divorce. The Act states that the court must make just and equitable orders in all circumstances.

When a divorce is granted, the court must consider the financial and non-financial contributions made by each party during the marriage.

These contributions include raising children, maintaining the home, and earning an income. The court will also consider the future needs of each party, such as their age, health, and earning capacity.

Separation and Divorce – what’s the difference?

Separation is the process of living apart and ceasing to live together as a couple.

Divorce, on the other hand, is the legal process of ending a marriage. It’s a formal process that involves applying to a court to have the marriage legally dissolved. In order to be eligible for a divorce, you must have been separated for a certain period of time, usually a 12-month time limit, and must be able to demonstrate that the marriage has irretrievably broken down.

One key difference between separation and divorce is that separation does not end the legal marriage or de facto relationship. Even if a couple is separated and living apart, they are still legally married or in a de facto relationship until they obtain a divorce. This means that they may still have legal responsibilities and obligations to each other, such as with respect to property settlement, spousal maintenance, and child custody and support.
